Terms of Use

These Terms of Use (the "Terms") apply both to anyone who registers an account with Amplistay to manage their accommodation (a "Host") and to anyone who books, pays, extends a stay, or otherwise uses a Host's page or payment link (a "Guest") - we refer to both as "User" wherever a clause applies equally. By registering as a Host, or by booking, paying, or otherwise using a Host's page or payment link as a Guest, you agree to comply with and be bound by these Terms.

If you are a Guest: your accommodation relationship - dates, price, house rules, cancellations - is with the Host, not with Amplistay, as explained further below. Amplistay's role is limited to providing the payment technology and the page where you book, pay, or extend your stay; it does not vet the Host or provide the accommodation itself. How we handle your personal data is explained in our Privacy Policy.

1. Service Description Amplistay is a specialized Software as a Service (SaaS) platform that offers vacation rental Hosts a single service: a website for their accommodation, with the following features included:

  • Payment Link: A technological interface for processing secure payments for direct bookings and stay extensions, through third-party processors.
  • Website: Hosting, either on the Host's own domain or an Amplistay subdomain, and prefilled legal pages for the Host's site.
  • Stay Management Tools: Systems for managing check-in/out extensions and stay-related add-ons.
  • Automated Logistics: Tools for the automated creation of internal records and booking synchronization for operational efficiency.

Depending on the plan chosen, the Host accesses these features under Fee per Booking (no monthly fee; a technology fee on payments) or Fixed Rate (monthly fee, custom domain, no fee on payments) - see sections 3 and 4 below.

Amplistay is not a party to any transaction, rental agreement, or service contract established between a Host and their Guest. Our role is strictly limited to providing the technological infrastructure to facilitate these operations. Amplistay is not a travel agency or a real estate broker.

2. Business Certification and Regulatory Compliance

  • Self-Declaration: By using the Platform to process payments or manage properties, the Host warrants that they comply with all local, regional, and national regulations, including the possession of required tourist licenses and tax registrations.
  • Indemnification: The Host is solely responsible for their legal and fiscal compliance. Amplistay does not verify the existence of licenses. The Host agrees to hold Amplistay harmless from any legal action, fine, or penalty arising from regulatory non-compliance.

3. Technological Intermediation and Payments

  • Nature of the Payment Link: The Payment Link is a private link, meant to be shared directly by the Host with their own guests (via WhatsApp, email, social media, or from their own website). Amplistay does not operate a search engine or public directory where Guests can discover or compare properties across different Hosts.
  • Fees: Amplistay charges a 3% technological service fee for each transaction processed through the Payment Link. This fee automatically drops to 0% while the Host keeps their Fixed Rate plan active, and is deducted (where applicable) at the time of the transaction via Stripe Connect.

4. Your Page: Hosting and Domains

  • Hosting: Every Host gets their own website hosted by Amplistay, on an amplistay.com subdomain. With the Fixed Rate plan, the Host can also connect and manage a custom domain. Ownership, registration, and renewal of any custom domain is the Host's sole responsibility.
  • Prefilled legal pages: Amplistay provides a legal notice, privacy policy, and cookie policy as an illustrative template for the Host's site. It is the Host's sole responsibility to review, complete, and adapt them to their own business, location, and applicable regulations before publishing their site.
  • Published content: The Host is solely responsible for the content of their website: descriptions, photographs, prices, and booking conditions.
  • Billing and cancellation: The subscription ($19/month) is billed through Stripe and can be cancelled at any time with no commitment; upon cancellation, the website is no longer publicly accessible.

5. Operational Responsibility Disclaimer

  • Data Accuracy: It is the User's sole responsibility to verify that booking dates, amounts, and metadata are correctly configured. Amplistay is not liable for operational failures resulting from incorrect user input or synchronization delays from third-party APIs.
  • Service Fulfillment: Once a payment is processed, the technological service is considered rendered. Amplistay is not responsible for disputes regarding the quality of the stay or the relationship between the Host and the Guest.

6. Accounts and Payments

  • Account Registration: The person creating the account warrants they have the authority to legally bind the Host to Amplistay.
  • Billing: All payments are processed through Stripe. By using the service, you authorize the charge of the selected fees and subscriptions and agree to the Stripe Connected Account Agreement.

7. Intellectual Property

  • Our Property: All content, software, and technology on the Platform are the exclusive property of Amplistay.
  • Your Data: You retain ownership of the information you upload, including your page's content. You grant us a limited license to process, store, and publish said content solely to provide the service.

8. Disclaimer and Limitation of Liability

  • The Platform is provided "as is" and "as available." Amplistay is not responsible for disputes, losses, damages, or fines arising from the use of our payment or website hosting tools, or from the relationship between a Host and a Guest.
  • Our total liability for any claims shall be limited to the amount of service fees and subscription charges collected by Amplistay from the user in the three (3) months preceding the claim.

9. Governing Law and Jurisdiction These Terms shall be governed by the laws of Spain. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.
